AN ACT TO AUTHORIZE THE BOARD OF TRUSTEES OF STATE INSTITUTIONS OF HIGHER LEARNING, THROUGH THE DEPARTMENT OF FINANCE AND ADMINISTRATION, TO SELL AND CONVEY CERTAIN STATE-OWNED REAL PROPERTY LOCATED IN BOLIVAR COUNTY, MISSISSIPPI; TO REQUIRE TWO APPRAISALS OF THE REAL ESTATE BEFORE IT IS PURCHASED; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The Board of Trustees of State Institutions of Higher Learning, through the Department of Finance and Administration and upon meeting the requirements of Section 29-1-1, may sell and convey any or all of the parcel of land described in this act which has been determined to be not needed in the operation of Delta State University. The land being described as follows:
Lot Six, Block Eighteen of College Heights Addition to the City of Cleveland, according to a map or plat of said Addition on file in the office of the Clerk of the Chancery Court of Bolivar County in Cleveland, Mississippi, together with all improvements thereon and all easements and appurtenances thereunto pertaining.
SECTION 2. The consideration for the property described in Section 1 of this act shall not be less than the average of the fair market price for the tract as determined by two (2) Mississippi certified general appraisers selected by the Department of Finance and Administration.
SECTION 3. The State of Mississippi shall retain all mineral rights to the real property purchased pursuant to Section 1 of this act.
SECTION 4. The proceeds from the sale and conveyance of the real property described in Section 1 of this act shall be deposited into a special fund in the State Treasury and shall be expended only for the benefit of Delta State University.
SECTION 5. This act shall be deemed to be full and complete authority for the exercise of the powers herein granted and shall not be in derogation of any existing law of this state, but shall be considered additional, supplemental and alternative to any other authority granted by law.
SECTION 6. This act shall take effect and be in force from and after its passage.
